So my wife likes to watch HGTV in the mornings and this show was on and I heard the old Hardy Boyz theme during it. May be a stupid question, but how would they get hold of that music?

Its just stock music,it features on alot of stuff apparently.

A lot of themes are nothing more than production music, songs you can license for a broad variety of things. This is also why WWF/E didn't include a lot of themes on their "The music/whatever" CDs, because they don't actually own the rights.
They would get ahold of such music by going through a production music company's catalogue. Same way WWE no doubt did.

Don't forget the first Uso's/Tamina theme used in that body wash commercial... WHILE it was still being used for their entrance.
But, yeah, the Hardyz theme and Baldcore Holly/Holly Cousins music seems to get around a lot. Oddly enough, and only semi-related, an instrumental to one song from the original Tony Hawk's Pro Skater seems to get around quite a bit as well (The Ernies - Here and Now).

The Hardyz theme was being used by Spike while they were with WWE on USA, as well.
I wonder if TNA could legally license them for use with former WWE talent or if WWE could call brand confusion/trademark infringement since those songs are connected to those wrestlers (say, the Dudleys theme).

It's easier for them to just do knockoffs, WCW style. Harder to sue.
I honestly don't think they could argue brand confusion over stock music, but WWE'd have a better foothold there than with the ripoffs they usually do.

I remember back in the day, someone actually bought Corporate Minsitry's 2nd theme. Ya know the one which had shane's voice in the background??. And it got released...

Yep...WWE has licensed a lot of those songs for use as themes or in video packages and whatnot. The one that always springs to mind for me is
