While normally it would take some kind of intent I believe to initiate a possible murder charge in this circumstance, the fact that he ran from the scene, returned to grab large amounts of cash, then ran again and hid for a couple days.....that mitigating circumstance says a lot. He probably would be charged with murder or at the very least vehicular manslaughter if the baby had died based solely on his reaction to the situation. The drug possession also would make him being charged much more likely.

My guess is if the child died they would get somewhere between a negligent homicide or a manslaughter charge, based on a very, very quick glance of Arizona law. Now if they could prove he was intoxicated, that could change. At least I"m assuming, I know in Ohio it would.

What he does afterwards, running, grabbing the cash, etc, realistically does not affect the charge. The only thing that really would matter is his own criminal negligence (neg homicide) or recklessness (manslaughter) in causing the act that caused the termination
