A federal appeals court has ruled that all musical samples must now be paid for, ending the free reign that many artists, especially rappers, had in using past hits to serve as foundations to new tracks.
Artists will now have to pay for ALL samples, even tiny snippets.
"Get a license or do not sample," the court said Tuesday. "We do not see this as stifling creativity in any significant way."
The case was based on the 1990 NWA song 100 Miles and Runnin' which featured a sample from the 1975 song Get Off Your Ass and Jam.

Downunder, have you ever heard of The Roots? They are rappers who play instruments. There are also many other rappers and producers who can play actual instruments (Kanye West, Andre 3000 of Outcast, etc).
It's mostly only the mainstream bullshit "artists" on the radio who can't. Next time I find you on Soulseek, I'm gonna show you the light. :mad:

And nobody is saying they can't play instruments. Poofy Daddy can be an excellent Viomalin or Tumababa player for all I know. He isn't making records with those sounds so who cares.

In this day and age of lawsuits, it's pretty uncommon to hear lawsuits over sampling or not crediting other people, etc. It still happens, but most people in the music biz are trying to make some cash, and prefer to do so without having to split it because they ripped someone else off.
