If I remember correctly, they did. But Hogan was using that name before he was in the WWF. I think Marvel was trying to get them to stop using the name, back then though, things weren't so strict as they are now. At least to my knowledge.

The later, official explanation for the "Hulk Hogan" moniker was that many considered Bollea to be physically bigger than Lou Ferrigno (http://en.wikipedia.org/wiki/Lou_Ferrigno), who at the time was starring in the popular TV series The Incredible Hulk (http://en.wikipedia.org/wiki/The_Incredible_Hulk_%28TV_series%29). McMahon also wanted him to be a tough, working-man brawler with a possible Irish (http://en.wikipedia.org/wiki/Ireland) background at the same time, thus the name "Hogan." A deal was later struck with Marvel Comics (http://en.wikipedia.org/wiki/Marvel_Comics) to use the "Incredible Hulk" name. In February 2005, Bollea himself purchased the rights to the name "Hulk Hogan" shortly after a copyright dispute between Marvel and World Wrestling Entertainment prevented Bollea from being called Hulk Hogan in rebroadcasts of his matches.http://en.wikipedia.org/wiki/Hulk_Hogan

That's how the beginning ove every match with Hulk Hogan goes. What they don't show is bloody, at the end of the match, just at the end of his rope. The Incredible Hulk hits him with some Gamma Smash, but Hogan no sells it ans shakes his head. Incredible Hulk replies with a few punches to Hogan's chest, but it has no effects and Hogan points at The Incredible Hulk and say "You!" and then waggs his finger at the giant green monster. Hogan then holds the top of the Incredible Hulk's head and throws fist that barley touch the back of Hogan's own hands. This devistates the green monster who is sent reeling from these devistating phantom punches. Then Hogan has him just where he wants him, so he places The Incredible Hulk against the rope, Hogan then tugs his arm slightly but the Incredible Hulk is sent to the opposite side of the ring at high speeds. Just before the green monster is about to hit the ropes, on the opposite side of the ring, chest first he for some reason turns around and hit's the back first propelling him back towards Hogan. Hogan then lifts his leg slightly higher then a dog does when he pees. The Incredible Hulk is then compolsed to duck his head into Hogan's boot, and falls to the ground. Hogan then bounces of the ropes stops right above The Incredible Hulk jumps an inch and a half off the ground an lands a bent leg over the neck of the green monster never actually touching it. However, the sheer force of this gravity devistates The Incredible Hulk as he is rendered unconsience. Hogan then covers him for the three count. Then WCW goes out of buisness.

Marvel was trying to get them to stop using the name because, apparently, he used to actually "hulk up" into a big green monster or some shit. According to Marvel, it was upon seeing this that they opted to take legal action. The legal action was taken, and then a deal was reached.

I honestly think there wouldn't have been a problem with the Hulk concept, if not for how literally he used to copy them. Even "Hulking Up" shouldn't have been an issue.

Anyway, this is what I remember from one of the articles regarding it from the Marvel POV.
