I finally ordered a 360 after getting screwed over once by a false seller (don't ask). This time, however, UPS apparently left it at the door of my apartment while everyone was at work, and when I got home 4 hours later there was nothing there.

:'(

I just wanna play video games.

So do you get your money back or are you fucked?

If it's UPS's fault, you're probably kinda fucked, since they technically delivered it. It'd be nice if they had to compensate you, but limited liability and whatnot.

I called UPS, and they said I had to contact the shipper and have them call UPS to have the package traced. I contacted overstock.com (who I ordered from), and they are putting a trace on the package (which probably just means they'll double check the tracker that I'm already aware of). They say the trace takes 1-4 days, and if they find that I legitimately didn't receive it, a replacement will be shipped within another 1-4 days. We'll see how that turns out.

...limited liability and whatnot.

Indeed, but I wonder what level of incompetance it would be to leave a $300+ package in crowded apartment complex when the other delivery services (and UPS usually as well) take them to the front office when there's no answer at the door.

It's the driver's fault. We never under any circumstances leave a package at an apartment building. It has to be signed for (technically), but a Driver Release must be to the hands of the customer (although the main office is perfect as well). I've had the driver of my apartments fucked over many times cause he never makes sure anyone is home. I've come home to packages sitting outside my door, and when it's to a co worker who knows the routine, you're either sliding by or getting fucked.

What should have happened is you call the 1-800 number, they ask for the tracking #, and then they get the driver in trouble. If the claim has been filed, you will get your money or xbox back.

Unfortunately most drivers do what they can to get in and get out because of the overwhelming amount of packages on the trucks to make scratch and 9 5.

Sorry for your troubles over a stupid mistake by the driver.

Not true. There is a procedure over apartment buildings, and the driver didn't follow it. He'll get his back.

Chat Information: Welcome to Overstock.com Customer Service, you are now chatting with Jethro.

Jethro: Thanks for visiting Overstock.com, this is Jethro, how can I help you?
you: I chatted with a representative about a package that I had not received yesterday, and he said there would be a trace put on it, but it has been over 24 hours, and I called UPS and they said a trace had not been requested yet.
Jethro: I'll be glad to check that for you.
[...]
Jethro: I've checked your account and found that a trace was already been set up on 09-11-2007 to locate the missing item.
Jethro: It will take 4 business days for the trace to be completed.
Jethro: If the item is located during the trace period, it will be delivered to you.
Jethro: If you receive the item during the trace period, please let us know about it.
you: 9-11?
Jethro: I'm sorry for the mis-communication, the trace was set up on 11/02/2007.
you: Okay.
Jethro: If the item couldn't be located we'll send the replacement at no cost to you.
you: It puzzles me, though, that when I called UPS they told me that there was no trace yet.
Jethro: Once the replacement is processed, it will ship from our warehouse within 1 to 4 business days and arrive within 2-15 business days from the day they are processed.
Jethro: No problem, actually it takes 4 business days for the trace to complete excluding weekends.
you: Well, the question isn't whether the trace has been completed, but whether or not it has actually been initiated at all.
you: It's not Overstock's competence I'm questioning, though, it's UPS'.
you: And it's nearly impossible to open reasonable communications with them, so I feel a bit left in the dark.
Jethro: Please be assured that a trace was set up on 11/02/2007 and once the trace is complete you'll be notified via email or phone.
Jethro: Is there anything else, I can help you with?
you: That'll do it.
Jethro: We appreciate your visit at Overstock.com. Thanks for your time.
Chat InformationChat session has been terminated by the Overstock Service representative.

The thing that worries me is that the trace will just lead them to the conclusion that it was delivered to my door, and I don't know what credibility I'll have in saying that I never actually received it.

I thought UPS had a policy that they couldn't leave anything totaling $200+ without signing for it unless you sign a waiver...

UPS is fucking retarded.

You dont leave a box outside of an apartment. Douches.

Around here, UPS and DHL both do it, even on "signature required" documents and such.

Speaking of shitty courier service.

I was awaiting a package a month ago or so and I called UPS to tell them that I wouldnt be home to accept the package. I asked if I could go pick it up at the office (I called a day before as soon as I got the tracking number) and they said they couldnt do anything until it was attempted.

What kind of logic is that? Save the driver some time and just leave it at the fucking office.

So, they attempted and I wasnt home, and I had to pick it up at the office anyway.

Dumbasses.

Yeah, that's company policy. It's ridiculous. They have to deliver it, first.

What's worse is that around here, they NEVER leave a note. They drop the package. I'm thankful I'm right under the ONE camera on this floor, because it means I can at least prove when someone else takes my shit.

Lazy motherfuckers.

My postman is too lazy to drop packages, to boot. They never even try, they just leave a note. Complete opposite.

Well, I just got the email from Overstock today, the trace is complete and they'll be shipping a replacement in 1-4 days.

Let's hope it goes more smoothly this time.
