I have officially boycotted all WWE programming because of their lack of ability in some cases to take a joke.

The burden of responsibility falls on the WWE for the posts on its messageboard, not the poster.

If they are presenting a message board that contains pornographic posts, the WWE is at fault for either a) not censoring/moderating their board, or b) not posting a content warning or age verifier prior to logging in. Since they claim to market towards children and that kids are seeing these images, then they are guilty of A. The poster cannot be arrested for exercising free speech. Banned or censored, yes. But again, that falls under A.

That's not true, the person doing that is legally liable for doing such act. The website/show/whatever is only responsible if they knew what was happening and/or did not do anything to stop it.

So if someone posts child porn on TPWW, Triple A would be held responsible for it and not the poster who posted it? Yeah I don't see that flying.

Pornography, in and of itself, is NOT illegal. Therefore, it falls under free speech. Child porn most certainly is, and yes, the poster would be held liable then. Although Triple A would probably want to censor and report that as fast as he could.

However, merely posting porn on a public website is not a criminal charge. I'm surprised the authorities actually detained this guy (perhaps the law is different in Dublin?) The burden falls on the website to either moderate their board, or properly warn visitors about offensive content. WWE did neither, and are trying to force liability on this guy.

Not to mention Pornography is probably against the WWE Fan Nations TOS which probably has a line in the user agreement where they can prosecute if they break any of them.

That's what I'm getting at. It's illegal for the TV station to AIR that. That's why we have the FCC. She would get in trouble for public indecency, yes, but there is no burden of responsibility on her for any minors that might see it. That falls on the network.

I agree wholeheartedly with DarKCentaur. There is nothing wrong with posting porn. It's perfectly legal. So what if WWE's major fanbase is children? That doesn't matter.
