So how can TNA do it?
 
I dont know if this question as already asked but I wanna ask it again how dose TNA get away with "Stone Cold" Sharkboy and "Black Machismo"? I remember WCW getting trouble with John Tenta having to change from "Avalanche" to the Shark because he was too similar to the Earthquake gimmick. Maybe a bit less know would be how WCW had an "Ultimate Wrestler" who turned out to be the Renagade who wore similar face paint to the Warrior and did the renagade splash but, was also forced to change his gimmick. I mean it's not like it's not the lines are any diffrent and I'm not sure but didnt Macho come out to the same music as Leathal dose?

One Renegade didn't have to change his gimmick, WCW Creative if you want to call it that, realized the fans were shitting all over him, but being a big cock tease.

Tenta on the other hand, I don't know what the deal was there.

And Yes...Lethal comes out to a similar version of Macho Man theme.

It should also probably be noted, that the WWE probably sees TNA's "parodies" as more harming to themselves than detriment to any potential business the E could do.

WCW had lots and lots of money back in the day, and Earthquake has his moments in the old WWF. It's understandable that Vince would be a little worried by "Avalanche." Shark Boy is not going to lead a wrestling revolution. TNA, as run by Russo and Mantel, is not going to lead a wrestling revolution.

There is also that right to parody thing.

Good thread. I'm surprised TNA hasn't gotten into some kind of legal trouble with others as well.

Take Christian Cages music for example. It's basically an instrumental version of "My Last Breath" by Evanescence. Or Monty Brown's theme back in the day, which was extremely similar to "Down With The Sickness" by Disturbed.

Kurt Angle's current music (instrument only) is based of a song in the 70's or 80's. I can't remember the title though. Then, remember Trytan? He had what? Two matches if that? Anyway, his music was a rip off of System of a Down.

When you think about it though, WCW and WWE did the same thing. Think about Raven and DDP both knocking off Nirvana. If you listen to Stone Cold's theme it is extremely similar to 'Bad to the Bone.' The WWE tweaked the sound a bit at least.

Then there's the punch lines...

Christian's music is a ripoff of his WWE music, by Waterproof Blonde.

Anyway, most of what you're talking about isn't covered under copyright law. If You could sue over an arrangement, Jet and the White Stripes would have been sued by Iggy Pop, and Nirvana by Boston. It's really hard to sue over the music to a song. Lyrics are what really count, and so if you have a song with similar music...
