Guitarist sues over 2008 Coldplay hit

LOS ANGELES (AP) — A noted guitarist has sued members of Coldplay, claiming the band's smash hit "Viva La Vida" copied parts of one of his songs.

The copyright infringement lawsuit by Joe Satriani was filed Thursday in federal court in Los Angeles.

The 52-year-old claims Coldplay copied "substantial, original portions" of his 2004 song, "If I Could Fly." The Coldplay hit, which was nominated for a Grammy this week, has topped charts around the world and been used to sell iPods in commercials.

Representatives for the band and their label, Capitol Records, did not return calls seeking comment on Friday.

Satriani wants a federal judge to order an accounting so he can determine how much money he may be owed, or else stop using the song.

If Coldplay were some garage band who'd just stumbled upon a huge hit or two I'd say Satriani's lawyers would milk them for all it was worth, but Coldplay being who they are (ie richer than Satch himself) it wouldn't surprise me if they put up a decent fight to this.

On the flip side, a garage band would be more likely to settle in the first place. Coldplay's looking at a shitload in damages here, and they really have NO leg to stand on.

I hope they get hit where it hurts. Nothing pisses me off more than when a musician or artists bites off of someone else.

Joe Satriani did the amazing guitar theme to Top Gun.

Then In Flames ripped it off for some song of theirs, biosphere maybe, and just sped it up. This was in high school, I noticed it and none of my friends believed me, and as far as I know there was never a lawsuit even though there should have been. I don't remember the song because I dont listen to that shit anymroe.

That's what it was. All of these kids had In Flames dicks so far down their throats they refused to admit it. I don't know how metal it is to rip off the theme to Top Gun. Not very metal I would say.
