I'd say the fact that Brian wrote it as a solo project (his words), recorded it as a solo project (his words) and only put it out under Queen (with re-recorded vocals so Roger had a verse) when they wanted an unreleased track for Rocks, vol 1 (His words) would certainly be a more compelling argument than lack of Freddie.

Note I didn't say "The Loser in the End" wasn't Queen.

Or "Sleeping on the Sidewalk."

Or "Someday One Day."

Or "All Dead, All Dead." Though the last two have backing vocals by Mercury.

Retroactively slapping the name "Queen" on something, however, does not make it Queen.
