The kid's underage and in danger so no, although the situation would be different - the guy would still be interacting with an underage child, actual age be damned. So yeah, he gets the flat mattress.

See how that works? Critical thinking, a just evaluation without some zero tolerance, interactionist bullshit? It's really not that hard.
