Pulling your opponent by the legs crotch-first into the ring post is something that I always envisioned as illegal. The rules have relaxed a little bit, but low blows are sort of meant to be illegal. If Kane continuously attacked Hardy's crotch by using the ropes, I can imagine that being a DQ.
Yeah, given that it happened twice I don't see too much of a problem with it. If it only happened once though I probably would have thought WTF.
