Not really relevant but one way in which Artificial Intelligence fails because 'Agents' can't really have 'Common Sense' as it is. With this I can see both sides. What BDC says is quite valid, the enemies should at least look up every so often to try to find Batman, it makes sense because as said they're looking for Batman. So how about a tension meter or setting the 'Agents' have within them.

When patrolling they don't look up often, this is a default setting for them. If alerted to Batmans presence then they look up at the rafters/gargoyles occasionally. Not enough for them to find you straight away but just enough to actually keep the player on their toes as it were.

Of course if the 'Agents' actually know Batman is there they'll look up and inspect everyone until they're certain Batman isn't there. As it is in the game they can see you when you head back to the rafters but after you move between 3-4 they'll loose track of you, so just variations on this.

You already see some examples of 'Agent tension' in the game when you see that as more are picked off they start acting differently and more wildly. You could even have different levels of 'Intelligence' for enemies, dumber henchman wouldn't look up much if at all because these are your really low level goons.
