Well both Jericho's & Mysterio's WCW Themes aren't actually owned by Time Warner, they're actually production themes, along with the nWo's theme.

I'm sure the WWE got this information when they bought out WCW and they had to purchase the production themes themselves so they could legally use them.

But I think the reason some themes aren't used on DVD's and so on is because the company that created the theme said no to the WWE using it for financial gain.
