The whole thing is noir. Characters wear suits because that's the type of characters they are... Not to mention there are plenty of major/great Batman villains who don't even fall into that category. Mr. Freeze, Scarecrow, Catwoman, Ras Al Ghul, Killer Croc, Poison Ivy, Harley Quinn, Hush, Red Hood, Deadshot Like I said, who really cares what they wear though, since I think it's virtually academic that Batman and Spiderman dominate the rogues gallery discussion.

Penguin wears a suit. And Catwoman wears a cat suit. And Alfred wears a suit. And the Fox fellow wears a suit. Game set and match.
