Look at the video, Spilly. Chara had his head up. He knew where he was. I'm not saying he intended to kill Pacioretti, but I do think he meant to put him into that divider. He doesn't even body him into the boards. It looks like he pushes him.
Even if he didn't see the divider, part of a player's job is to know his position on the ice. If the divider isn't there, the hit is still dirty because it's well after Pacioretti has gotten rid of the puck.
Even if Chara didn't have intent on the hit, it doesn't matter. If I have a gun and I'm waving it around and accidentally shoot someone, I'm fucked, whether I intended to or not. He should've got at least a few games suspension.
