The Supreme Court is expected to make a decision this Fall regarding a legal case involving the First Sale Doctrine with the implications being against the consumer if manufactures win.

While the case itself doesn't specifically involve video games, they would fall under the provision to be removed from the protection the Doctrine provides to consumers.

The current case of Kirtsaeng v. John Wiley & Sons involves the side of John Wiley & Sons requesting portions of the Doctrine to be overturned or amended to remove any product manufactured "overseas" from its protection.

The publisher also wants those products to then fall under the copyright protections which provides more power to manufactures in determining who can or can't sell/resell their products regardless of location.

As of now the Court is split on the legality of the product's origin and location of sale mattering which will end up playing a large role in their actual decision later on.

Should the Court side with the publisher, video game consoles would automatically be exempt from the Doctrine while games in general could if the exemption is expanded again in the future.
