I'm not sure if they really could legally argue it in this case. Consider, if they take this to a serious court of law, then the point will be made that clearly the auction itself was a joke and in no way serious and therefor any bids placed on it could also be considered as jokes. I think with something like Ebay both parties have to act in good faith, and clearly auctioning off a cardboard WiiU controller is not acting in good faith on the sellers part.
