Why didn't they make their claims when Eugene first came out? I suspect this is a case of riding on Eugene's popularity to gain some cheap publicity.
Well, usually you don't make a claim immediately anyway. Why would you? If you take a little more time, you might be able to get more evidence.

Besides, they only waited three months. There are people filing retroactive lawsuits for ten year old issues. three months is still pretty reasonable.
