Depends on the age of the fetus, really. While normally it would take some kind of intent I believe to initiate a possible murder charge in this circumstance, the fact that he ran from the scene, returned to grab large amounts of cash, then ran again and hid for a couple days.....that mitigating circumstance says a lot. He probably would be charged with murder or at the very least vehicular manslaughter if the baby had died based solely on his reaction to the situation. The drug possession also would make him being charged much more likely.
