He does though. He doesn't even "win dirty". He can't even cheat his way to victory outside of one match a month basically. He loses all the time. If he were constantly finding ways to win through being a cunning/chicken shit heel, that would be fine. As it stands, the guy holding the most coveted title in the company is a jobber. It doesn't make sense.
