I don't know the full details, but I think somehow it involves the 4th amendiment, also the testing done was confidential ie: records not release, same way if a company send you for a drug test and you fail, they don't call the cops.
Also to top it off, I'm pretty sure the players rec'd immunity from charges (for use and also in some cases for pergery) in return for testimony, the gov't is after the company, not the users. Same way if I got caught w/ Coke and turned over the person I got it from I'd get a lesser or no charge in return for helping w/ a case against a distributer.
Distrubting is a bigger crime then use.
