Self defense isn't always "he hit me first" if you feel threatened that's still self-defense.

I agree with that, if he felt threatend, but there's no way unless he's a complete idiot that he could have felt threatend at that point, the guy wasn't anywhere near him.
it will be interesting to see what the courts finally do when it's all over.
