It has to be unlocked using a downloaded hack for PC, or an Action Replay (hack device) for the consoles. So basically it has to be looked for, so if you come across it, I believe its your fault, not the developers.
Sure, it wasn't the best idea putting it in there if they knew it was possible to be unlocked, but you have to TRY to see it, it's not like it just suddenly pops up in your face.
