the golden rule, it doesnt matter who created it first, its who copyrighted it first. Vince tries to own everything. If he thinks its irrelevant like a couple of old boys making 30 bucks he wont care (demolition using the name and look on the indy scene) But as he has shown before, if something could make a bit of money, he will get the lawyers involved.
