Has a face wrestler ever been caught doing it and not DQed?

Because my thought on the matter was simply that Cole was arguing self defense: The heel has introduced something bad, but he's reminding us the face's use is ONLY because the heel was going to use it first. It's simple, to my knowledge complete, and doesn't require overthinking.

That's what I entertained in my post, but that doesn't fit with babyface hero Cole. You know, the guy who claims Chris Benoit wasn't going to put Sharmell in the Sharpshooter, even though he forced her to stay down, and set-up for the move? The guy who claimed Matt Hardy did not encourage his brother to jump off a ladder, and wasn't going to give Sharmell the Twist of Fate in Money in the Bank?
