Wrestling-Death Killer Signs Papers OK'ing Deal

MIAMI — The mother of a Florida teen who beat a 6-year-old playmate to death said neither she nor her son is happy with the terms of a plea deal yet chose to accept it simply so he could have freedom.

Lionel Tate (search), 16, signed papers Sunday agreeing to plead guilty to second-degree murder in the 1999 beating death of Tiffany Eunick. Tate could be freed by the end of the month from a maximum security juvenile prison in Okeechobee.

"My son wants to come home. I want him home," said Kathleen Grossett-Tate. "He did not receive a fair trial the first time. For us to go back to trial again, I know he would not get a fair trial."

An autopsy showed Tiffany suffered a fractured skull, lacerated liver, broken rib, internal hemorrhaging and cuts and bruises. Tate's trial attorneys argued he accidentally killed her while imitating the moves of professional wrestlers he saw on television.

Grossett-Tate said she would have preferred her son to plead guilty to manslaughter (search) since she and her son contend Tiffany's death was accidental. They declined the same second-degree murder plea deal before Tate's trial.

Tate's first-degree murder conviction and life sentence were overturned last month after state appellate judges ruled that his mental competency (search) should have been tested before trial. Following that decision, prosecutors again offered the plea deal, giving the teen a rare second chance.

In the deal, Tate is agreeing to be sentenced to three years in prison -- most of which he has already served -- plus one year of house arrest and 10 years probation.

"Just knowing it's all been signed, I'm very happy for him that he and his mom are on the same wavelength and moving forward," said Richard Rosenbaum, Tate's attorney.

A judge still has to ratify the plea deal, a process that could take a few weeks, Rosenbaum said. No hearings have been scheduled.

Ken Padowitz, who prosecuted Tate and now represents Tiffany's mother in private practice, did not return a message left Sunday. He said Saturday that the girl's mother was pleased that Tate was accepting responsibility for the murder.

Special prosecutors appointed nearly two years ago cleared Grossett-Tate, a Florida Highway Patrol trooper, of any wrongdoing in Tiffany's death. Grossett-Tate was baby-sitting Tiffany in her Pembroke Park home and said she was upstairs napping when the girl was injured.

This whole affair just smells! How can an adult be babysitting and NOT know this was going on? How can an "accident" cause a fractured skull, lacerated liver, broken rib, and internal hemorrhaging? This kid is a teenager - she was 6 for Christ sake - he should NOT be set free.

I agree with you. I'm sure she couldn't get all those injuries from just one move. A normal kid knows when to stop.

As a FL resident,and someone who followed the case from when
it began,I think that he is DEFINITELY guilty,and should serve a
great deal of time more than he what he is getting away with...

HOWEVER

I also think that his mother was/is a VERY stupid woman for tur-
ning down the original deal that would have seen her son avoid
the mess that this has all been turned into.

Anyway, I blame the kid for doing what he did, but I blame the parent too. It isn't right, and I don't think it was intent to kill her, but that is what happened. I don't think he'd deserve something like a Death Penalty, but time in jail and/or a good long list of community service would be a better punishment...

You know, I'd like to just leave this post alone, but I've gotta at least point out the like 6 year age difference between the girl who was killed and the idiot who killed her. 6 year old boys aren't very tough against people twice their age either.

I honestly believe his intent wasnt to kill her, and I doubt his mental capacity would have proven strong enough to show that he is able to have self control. But I think that sentencing a 12 year old to life in prison without perol (spelling) is way too harsh, despite the crime. I am glad that they released him, but i think he should see lots and lots of therapy.

The kid is sick in the head, and should stay in a permanent Juvenile Detention center until he's old enough to move on to a regular jail. The fact that the little girl suffered such severe injuries is proof enough that he didn't just perform "a move or two," it had to have been a beatdown of massive proportions. Hell, professional wrestling probably wasn't even going through his head. He probably said a bad word, she threatened to tell on him, and he beat the living shit out of her. **** this kid, send him to jail.

I agree. I just dont think that it is right for someone to kill someone much weaker and be released onto the streets after 4 years. He could do it again and isn't fair on the girls family and freinds that they will never see her again yet the person who did it is free to get on with their life.
Allthough I dont think he should be raped or killed, but should have a punishment.

If I was the relative of the girl in this case, and I wished rape and painful death upon someone around half my age, I would be no better than he was when he stomped the girl to death. Just as you have proven yourself to be.
