There's still a debate going on about this. Some say the hacked firmware can be detected by MS, while the creators think its more of a problem of the burned discs going inside the console. Some people, however, have sworn to getting banned with a modded drive without ever putting a hacked disc in a console. Don't know why you would mod a console only to play originals, honestly.
