Yes he could, alls they'd need to do is talk about how "Cain wears that mask to cover his disfigured face from burns he received as a child." They could say acid burns, burns from boiling water, burns from anything besides a fire started by his brother the Undertaker and it wouldn't be gimmick infringement.
