Probably not broken for a few reasons.

1) much easier to just have them be relatively normal if they're just going on o be popped into a match, since they can't really explain the gimmick.
2) Easy test to see if Anthem is suicida enough to try to legally threaten WWE just to having the Hardys at all.
3) Gotta sell that vintage Hardys merch.
