If somebody wins an auction, but doesn't pay for the item, can that person be sued? I know, stupid question, but I gotta know.

If you win and don't pay, you are breaking a LEGALLY BINDING CONTRACT, so yes.

I won a couple of auctions. The problem is, I have fallen on hard times and having serious difficulty with finances right now. I just emailed the people I won items from, so I hope they're understanding.

It's also worth pointing out that eBay offers protection for both bidders and sellers, but rarely actually PROVIDES it.

While you CAN get sued, it's more likely you'll get negative feedback at worst.

They won't do shit. Some guy fucked me out of $300 (a processor that I bought, didn't ship it and wouldn't return my money) and E-Bay didnt do anything to help me.

I did, the Portland Police Department said I woul dhave to take it up with the Ohio State Police Department (where the seller was located) and then the OSPD said I would have to take it up with the Portland Police Department.

When the item costs enough, and I believe is in a different state, it becomes a federal offense, and the FBI or some organization gets involved. A guy I know in a college class bought something for his car on ebay, and never got the item after paying. He emailed ebay, and they got the feds involved. Friend got his money back.
