I'd say WWE,

For 2 reasons.

Firstly, bodies are not as essential now to become a big player since the whole Benwho thing (see CM Punk)

Secondly, they are desperate for ratings, a 'big' return for a little ratings spike would be greatly received.

This is why I think RVD is biding him time and when he comes back all that weed nonsense will be out of the window and he'll be straight into the main event
